What is a trademark?

A trademark is a word, symbol or design, or a combination of all three used to distinguish the products or services of a person or entity from those in the market place.

How are trademark rights acquired?

Trademark rights are generally acquired through the use of a mark or by filing an application to register a mark.

Do I need to conduct a trademark search before using my mark?

Yes; although there is no law specifying that a search must be conducted, screening can help you narrow a list of potential trademarks while comprehensive research provides the information needed for a trademark attorney to make an opinion about clearing or registering a mark.

What is a service mark?

It is a trademark that identifies and distinguishes the services of a person or an entity from those in the marketplace.

What does the ® symbol mean?

It signifies that a trademark is registered with the relevant Trademark Office.

What does the ™ symbol mean?

It signifies that a mark is intended to be a trademark but has not yet been registered with the relevant Trademark Office.

What does copyright protect?

Copyright, a form of intellectual property law, protects original works of authorship including literary, dramatic, musical, and artistic works such as poetry, novels, movies, songs, computer software and architecture. Copyright does not protect facts, ideas, systems, or methods of operation, although it may protect the way these things are expressed.

What is a tradename?

It is a name under which a person or entity conducts business. It can also be registered as a trademark if it is also used to identify and distinguish products or services in the marketplace.
